1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and Gabin Sales Consulting, doing business as Gabin Growth Co ("Gabin Growth Co," "we," "us," or "our"), covering your use of GabinGrowthCo.com (the "Site").

By using the Site, submitting a form, or booking a call, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. Who can use the Site

You must be at least 18 years old and able to enter into a binding contract. If you are using the Site for a company, you confirm that you have the authority to accept these Terms on its behalf.

3. What this Site is

The Site describes our services and lets you apply for a call with us. Everything on it is for general information. Nothing on the Site is an offer, a contract, or a guarantee of any result. Any actual engagement between us is governed by a separate written agreement, not by this Site.

4. Results and earnings disclaimer

Any forward-looking statements on this Site are estimates of what may be possible. They are not guarantees. We make no representation that you will earn any money, that you will earn the amounts shown, or that you will avoid losses. You alone are responsible for your business decisions and their outcomes.

5. Case studies and testimonials

The case studies and results shown on the Site reflect the experience of the specific businesses described. Some of them are businesses we own or operate ourselves, and we disclose this on the page where they appear. These examples are not typical, not average, and not a promise of your results.

Names of coaches, trainers, or other professionals mentioned on the Site are used to describe our founder's own training and background. Mentioning them is not an endorsement of us by them, and it does not imply any partnership, affiliation, or sponsorship.

6. No professional advice

Nothing on this Site is legal, tax, accounting, financial, or investment advice. We are not your lawyer, your accountant, or your financial advisor. Talk to a qualified professional in the right field before making decisions that affect your business or your money.

7. Applications and calls

Submitting an application does not create any obligation for us to work with you, and it does not obligate you to buy anything. We may accept or decline any application for any lawful reason.

You agree that the information you give us on the form and on the call is accurate to the best of your knowledge. We rely on it in deciding whether we are a fit.

Booking a call means agreeing to be contacted about that call. If you need to cancel or reschedule, use the link in your confirmation.

8. Client engagements

If you become a client, a separate written services agreement will govern that relationship, including scope of work, fees, payment terms, timelines, ownership of deliverables, and termination. Where that agreement conflicts with these Terms, that agreement controls for the services it covers.

Any timeframe mentioned on this Site, including the installation period we describe, refers to our standard scope of work and depends on you providing access, information, approvals, and cooperation on time.

9. Intellectual property

The Site and everything on it, including text, design, graphics, logos, and the Gabin Growth Co name and marks, belongs to us or our licensors and is protected by intellectual property laws. You may view and print pages for your own reference. You may not copy, republish, resell, or create derivative works from any of it without our written permission.

Any feedback or ideas you send us about our business or the Site may be used by us freely and without any obligation to you.

10. Acceptable use

You agree not to:

• Use the Site for anything unlawful, or to submit false or misleading information
• Submit someone else's contact information without their permission
• Attempt to gain unauthorized access to the Site, its systems, or its data
• Introduce viruses or any other harmful code
• Scrape, crawl, or harvest data from the Site by automated means without our permission
• Interfere with the Site or with anyone else's use of it
• Copy our content, structure, or copy for a competing offer

13. Limitation of liability

To the fullest extent permitted by law, Gabin Growth Co and its owners, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business opportunity, or goodwill, arising out of or related to your use of the Site, whether based in contract, tort, negligence, strict liability, or any other theory, even if we have been advised of the possibility of those damages.

To the fullest extent permitted by law, our total liability for all claims relating to the Site will not exceed one hundred US dollars ($100.00) or the amount you paid us for the Site, whichever is greater. This limit does not apply to services governed by a separate signed services agreement, which contains its own terms.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Gabin Growth Co and its owners, officers, employees, and contractors from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

15. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of law rules.

Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the courts located in Bergen County, New Jersey, USA, and you and we consent to the personal jurisdiction of those courts.

Any claim must be brought within one year after it arises, or it is permanently barred.

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms is not a waiver of it.

16. Changes to these terms

We may update these Terms at any time. When we do, we will change the "Last updated" date at the top. Continuing to use the Site after a change means you accept the updated Terms.
